Smartcut Pro – Terms Of Use

These Terms of Use apply to the SmartCut Pro mobile application created by yazilimk (“SmartCut Pro,” the “Application,” “we,” “us,” or “our”). SmartCut Pro is a local-first mobile application offered as an ad-supported service with optional paid features, including subscriptions and, where available, other premium purchase options.

By downloading, accessing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Application.

Please also review our Privacy Policy, which explains how information may be processed in connection with your use of the Application.

1. Eligibility and Acceptable Use

You may use the Application only in compliance with applicable laws and regulations. You are responsible for ensuring that your use of the Application, including any cutting plans, calculations, exports, or purchases, complies with the laws and safety requirements that apply to you.

You may not use the Application in a way that interferes with its operation, attempts to gain unauthorized access to systems or accounts, bypasses commercial or technical restrictions, or misuses the Application for unlawful, abusive, fraudulent, or harmful purposes.

2. License and Intellectual Property

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Application for personal or internal business use on compatible devices that you lawfully control.

The Application, including its code, design, branding, trademarks, text, graphics, databases, and related intellectual property, remains the property of yazilimk or its licensors and is protected by applicable intellectual property laws.

Except where applicable law clearly permits otherwise, you may not copy, modify, adapt, distribute, sell, lease, sublicense, reverse engineer, decompile, attempt to extract source code from, or create derivative works based on the Application or any part of it.

3. Local-First Operation, Your Data, and Backups

SmartCut Pro is designed as a local-first application. Your project data, including cutting lists, dimensions, layouts, and similar project content, is primarily stored locally on your device. We do not operate a general cloud-sync service for your project content as part of the core Application experience.

You are solely responsible for maintaining backups of your important project data. If your device is lost, reset, damaged, replaced, or uninstalled, we may not be able to recover your local project data for you.

Your device or operating system may provide backup or device-transfer functionality. Depending on your platform and settings, saved projects and certain app preferences may be restored by those platform features. However, usage limits, rewarded credits, offline Pro grace periods, and in-app review timing may remain device-specific and may not be restored in the same way.

4. Device, Connectivity, and Platform Responsibility

Certain features of the Application may require an internet connection, compatible hardware, a supported operating system, or access to third-party platform services. We do not guarantee that every feature will always be available, uninterrupted, or compatible with every device, region, network, or operating system version.

You are responsible for your device, electricity usage, battery state, network availability, carrier charges, roaming charges, data usage costs, and any fees charged by your mobile network, app marketplace, payment provider, or other third parties.

We strongly recommend that you do not jailbreak, root, or otherwise compromise your device’s security protections. Doing so may expose your device and data to security risks and may cause the Application to malfunction.

5. Advertising, Privacy Options, and Telemetry Controls

SmartCut Pro may display advertising in the free tier or in non-premium experiences. Advertising and measurement choices may be managed through Google’s User Messaging Platform (UMP) and any required Privacy Options entry points provided in the Application.

Usage analytics and crash reporting are separate controls. They may be managed independently under Settings → Telemetry & data. These controls do not replace the Google advertising consent flow, and the advertising consent flow does not turn product analytics or crash reporting on or off.

6. Purchases, Premium Access, and Billing

SmartCut Pro may offer premium features through auto-renewing subscriptions and, where made available in the Application or app store listing, through non-subscription premium purchase options such as lifetime access.

Prices, features, packages, durations, entitlements, trial availability, and premium benefits may vary by country, platform, store configuration, paywall configuration, experiment, or time. The specific purchase terms shown to you in the Application or in the relevant app store at the time of purchase control for that offer.

If you choose to make a purchase, payment will be charged through your app store account or the applicable platform billing provider at confirmation of purchase, subject to the rules and flows of that platform.

Auto-renewing subscriptions renew automatically unless canceled in accordance with the rules of the relevant app store or billing provider. You can manage, cancel, or review your subscriptions through your app store account settings.

We do not process payment card details directly. Billing, renewals, cancellations, taxes, receipts, and most refund handling are managed by the relevant app store or payment provider under its own terms and policies. Where platform tools permit, we may assist with support relating to purchase status or entitlement restoration, but the payment transaction itself is handled by the applicable store or provider.

Subscription and entitlement management may be supported by third-party infrastructure such as RevenueCat. Premium access may depend on valid platform purchase records, entitlement status, and successful synchronization with the applicable billing and entitlement systems.

7. Free Tier, Limits, Ads, and Export Restrictions

Certain features of SmartCut Pro may be limited in the free tier. Limits, ads, premium prompts, export conditions, or other commercial restrictions may apply depending on the version of the Application, your purchase status, current product configuration, and the offer currently made available to you.

For free-tier users, exported PDF files or similar outputs may include a SmartCut Pro watermark. If a watermark is applied by the Application for your current tier, you may not remove, obscure, falsify, or misrepresent that watermark in a way that violates these Terms, applicable law, or the intellectual property rights associated with the Application.

8. Exported Files and Your Responsibility for Their Use

The Application may allow you to generate or share PDF reports and other exported materials. Once you export, share, print, email, upload, or store those files outside the Application, they may be handled by the destination app, storage service, printer workflow, messaging tool, or platform feature that you choose.

You are solely responsible for reviewing exported outputs before relying on them, sharing them, sending them to customers, or using them in any production, workshop, job-site, or fabrication context.

9. Cut Optimization Disclaimer and Safety Notice

SmartCut Pro is a mathematical planning and visualization tool intended to assist with cut optimization, planning, estimation, and workflow convenience. It is not a substitute for professional judgment, workshop safety procedures, measurement verification, tool calibration, machine setup, or on-site inspection.

You must independently verify all measurements, dimensions, trim margins, kerf values, stock selections, material assumptions, and cutting plans before performing any physical cuts, fabrication, machining, or related real-world operations.

We do not guarantee that generated cut maps, measurements, layouts, optimization outputs, or PDF reports will always be complete, error-free, suitable for your exact material, or appropriate for your specific machinery, safety environment, or production process.

You assume all risks arising from physical cutting, fabrication, material handling, workshop operations, and any reliance on the Application’s calculations, diagrams, or exported outputs.

10. Limitation of Liability

To the fullest extent permitted by applicable law, the Application is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory.

To the fullest extent permitted by applicable law, yazilimk and its affiliates, licensors, suppliers, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, contracts, goodwill, reputation, data, or anticipated savings arising out of or related to the Application or these Terms.

This includes, without limitation, losses arising from inaccurate or incomplete outputs, material waste, ruined stock or panels, failed exports, failed purchases, billing sync issues, service interruptions, device failures, backup failures, compatibility issues, third-party platform failures, network outages, or reliance on the Application without independent verification.

To the fullest extent permitted by applicable law, we also disclaim liability for physical injury, equipment damage, workshop damage, or financial loss resulting from the use of cutting plans, calculations, diagrams, or exported reports generated by the Application.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Third-Party Services and External Terms

The Application relies on or interoperates with third-party services. Your use of those services may also be governed by the relevant provider’s own terms, privacy notices, and policies. Relevant third-party services may include:

We are not responsible for third-party services, third-party billing decisions, third-party outages, or third-party terms, except to the extent required by applicable law.

12. Updates, Changes, and Availability

We may update, modify, suspend, discontinue, replace, or limit all or part of the Application at any time, including features, pricing, premium offerings, limits, compatibility requirements, supported devices, supported operating systems, or service availability.

You may need to install updates in order to continue using some or all parts of the Application. We do not guarantee that the Application will always remain available, supported, or compatible with every device, operating system version, or region.

13. Suspension and Termination

We may suspend or terminate your access to the Application, or your right to use parts of the Application, if we reasonably believe that you have violated these Terms, misused the Application, interfered with its operation, or created legal, technical, or commercial risk for us, our users, or our service providers.

Upon termination, the rights granted to you under these Terms will end immediately, and you must stop using the Application. Termination will not affect any rights or obligations that by their nature should survive termination.

14. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the effective date shown on this page and may provide additional notice where required by applicable law or where we consider it appropriate.

Your continued use of the Application after updated Terms become effective means that the updated Terms will apply to your future use of the Application to the extent permitted by law.
